Terms & Conditions

These Terms & Conditions ("Terms") form a binding agreement between you and MailCrypted ("MailCrypted", "we", "us") governing your access to and use of our website, applications and services (collectively, the "Service"). By creating an account or using the Service you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy, Refund Policy, Acceptable Use Policy and Cookie Policy.

1. Eligibility & accounts

• You must be at least 18 years old and legally able to enter into a contract.
• You must provide accurate registration information (email, phone, account type) and keep it up to date.
• You are responsible for all activity that occurs under your account and for keeping your credentials confidential.
• One person may hold at most one Seller account and one Tester account. Creating multiple accounts to evade limits or bans is prohibited.

2. Nature of the Service

MailCrypted is a communication platform that lets Amazon sellers and product testers exchange private product feedback through encrypted chat and email. MailCrypted is not a review-generation service, is not affiliated with Amazon.com, Inc., and does not guarantee sales, rankings, reviews, matches or specific business outcomes.

3. Subscriptions & billing

• Certain features (Seller plans, additional tester contacts) require a paid subscription.
• Subscriptions renew automatically at the end of each billing cycle at the then-current price until cancelled.
• You may cancel at any time from your account settings; cancellation stops future renewals but does not create a right to a refund of the current cycle.
• Prices, taxes and features may change on renewal; we will give reasonable notice by email or in-app.
• Unused monthly contact credits do not accumulate and are forfeited at the end of each cycle.

4. Refunds

All fees paid to MailCrypted are final and non-refundable, except where a refund is required by mandatory local law. Full details, including the limited exceptions we will consider, are set out in our Refund Policy.

5. Acceptable use

You agree not to use the Service to send spam, harass other users, request or offer public reviews in exchange for products, share illegal content, infringe intellectual property, attempt to reverse engineer the Service, or circumvent security or rate limits. See our Acceptable Use Policy for the full list. We may suspend or terminate accounts that violate these rules without refund.

6. User content & license

You retain ownership of the messages, files and profile information you submit ("User Content"). You grant MailCrypted a worldwide, non-exclusive, royalty-free licence to host, store, transmit and display your User Content solely to operate, secure and improve the Service. You represent that you have all rights necessary to submit the User Content and that it does not violate any law or third-party right.

7. Communications & email bridge

The Service delivers chat messages by email when a recipient is offline. By using the Service you consent to receive transactional and service-related emails. Marketing emails are optional and can be unsubscribed at any time.

8. Intellectual property

MailCrypted, its logo, software, design and documentation are owned by MailCrypted and protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.

9. Third-party services

The Service integrates third-party providers for hosting, authentication, payments and analytics. Their services are governed by their own terms and privacy policies. MailCrypted is not responsible for third-party services.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. Feedback exchanged between users is their own; MailCrypted does not verify the accuracy of product claims or test results.

11. Limitation of liability

To the maximum extent permitted by law, MailCrypted, its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim will not exceed the greater of (a) the amount you paid to MailCrypted in the twelve (12) months preceding the claim or (b) USD 100.

12. Indemnification

You agree to indemnify and hold MailCrypted harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

13. Termination

You may terminate your account at any time from your settings. We may suspend or terminate your access with or without notice if you breach these Terms, create risk to the Service or other users, or if required by law. Sections that by their nature should survive termination (fees owed, IP, disclaimers, liability, indemnity, dispute resolution) will survive.

14. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced by email or in the app. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which MailCrypted is established, without regard to conflict-of-law rules. Any dispute will be resolved by the competent courts of that jurisdiction, unless mandatory consumer-protection law grants you a different forum.
